The petitioner apprehends his arrest in connection with Pothia (Paharkatta) P. S. Case No. 42 of 2015 instituted under Sections 323, 341, 380, 384, 427, 420, 448, 504 and 506/34 of the Indian Penal Code.
The allegation, in brief, is that five years back, the petitioner promised the informant and others to give them employment in a Tea Garden and would get their Voter Card made as a resident of that locality. Believing him, he constructed a house in the area and Rs. 20,000/- given by each 30 persons and he started taking rent of Rs. 1000/- per month from them. It is alleged that on the date of occurrence, this petitioner along with other accused persons came and ousted the informant from the house.

No.15383 of 2017 (2) dt.15-06-2017 2/2 Learned counsel for the petitioner submits that in fact the petitioner and the informant were living on the Government land and due to some dispute as neighbours, petitioner has been falsely implicated in this case moreover the allegation is of five years back and the petitioner is a tribal and has got no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Ramu Hembram @ Charan Hembram @Ramu Hemram @ Ramu Hubram @ Charan Hemram @ Charan Habrum in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Kishanganj in connection with Pothia (Paharkatta) P. S. Case No. 42 of 2015; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
