2. The petitioner seeks bail in connection with Shankarpur P.S. Case No. 36 of 2024 registered for the offence under Sections 341, 307, 302/34 of the Indian Penal Code and 25(1-B)a, 26, 27, 37 of the Arms Act.

3. As per the prosecution case, Dinesh Das has been killed by Rupesh Kumar Yadav who has been killed by the mob.

4. One Raj Kishore Yadav was injured in the occurrence and he has said that Rupesh Kumar Yadav had killed the deceased.

5. The petitioner is the father of Rupesh Kumar

Patna High Court CR. MISC. No.49575 of 2024(2) dt.24-07-2024 2/2 Yadav and he has not been found to be involved in the crime which is clear from the CCTV footage. The petitioner is in jail since 1.3.2024.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Madhepura / concerned Court below in connection with Shankarpur P.S. Case No. 36 of 2024.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
