JUSTICE BIRENDRA KUMAR ORAL ORDER 28-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420/406/409/467/468/471/120B of the Indian Penal Code. The petitioner was posted as Child Development Project Officer, Barbigha, Sheikhpura. The informant alleges that she along with others misappropriated the fund allotted for disbursement amongst the pregnant lady, malnourished children and others as well as for providing dress to the beneficiaries. Initially, the matter was enquired by the authority, named in the F.I.R., and the allegation was found untrue. However, liberty was
Patna High Court Cr.Misc. No.17504 of 2017 (3) dt.28-06-2017 2/2 given to the informant to lodge criminal case. Thereafter, F.I.R. has been lodged with name of the beneficiaries. The available case-diary does not reveal that any record was examined to substantiate payment of the money against the named beneficiaries and statement of beneficiaries that they have not received any amount. Hence, apparently, there is no material against the petitioner to compel her to go to jail.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura/Successor Court in connection with Barbigha (Kewati) Police Station Case No.47 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
