JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 30-06-2016 Learned counsel appearing on behalf of the petitioner submits that during the pendency of the writ petition the sole petitioner has passed away, but despite all his communications his heirs and legal representatives have not turned up to file an appropriate petition seeking their substitution and seeking permission of this Court to prosecute this litigation. In view of the death of the sole writ petitioner and in view of the fact that no substitution petition has been filed in the present case, the writ petition has abated and is, accordingly, dismissed.
However, dismissal of the writ petition shall not come in the way of the heirs and legal representatives of the deceased petitioner to agitate their grievances/claims, if cause of action still survives.
