The petitioner is apprehending his arrest in a case registered under Sections 366A and 120B of the Indian Penal Code.
Allegation is that the accused persons including the petitioner kidnapped the grand daughter of the informant with intention to marry.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The victim girl has been examined under Section 164 Cr.P.C. where
Patna High Court Cr.Misc. No.28430 of 2017 (2) dt.01-07-2017 2/2 she has not supported the allegations made in the F.I.R. She has admitted to have married with the petitioner. Her age is being assessed to be 20 years.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Vth, Vaishali in connection with Kartahan P.S. case No.42 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
