The petitioner seeks pre-arrest bail in connection with Complaint Case No. 148 c-2 of 2004 in which cognizance has been taken for the offence punishable under Section 47(a) of the Excise Act.
Regard being had to the allegation made under Section 47(a) of the Excise Act for which cognizance has been taken by the court below in the year 2003, I am not inclined to entertain the present application filed under Section 438 of the Cr. P.C. The application is dismissed, accordingly.
