2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 504, 506, 494 and 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

3. Petitioner, who is husband of opposite party no2., is said to have ousted the opposite party no.2 from her matrimonial home in association of his family members over the dowry demand.

4. Learned counsel for the petitioner submits that the allegation of demand of dowry and torture is false and

Patna High Court CR. MISC. No.50280 of 2024(10) dt.26-06-2025 2/2 concocted. The petitioner is always ready to keep his wife with full dignity and honor and even today, the petitioner maintains the same stand and has made such averment in paragraph 10 of his petition.

5. As a matter of fact, it is the O.P. No.2, who has deserted the petitioner and is not willing to continue with the conjugal life. It appears that the mediation had taken place at Madhepura but the same remained unsuccessful.

In such view of the matter, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Udakishunganj, Madhepura, in connection with Madhepura Complaint Case No.135 of 2023 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482 (2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner shall co-operate in the investigation/trial.
