The petitioner, who is in custody since 09.03.2022, seeks bail in connection with Special Case No. 140 of 2020 arising out of Naubatpur P.S. Case No. 388 of 2020 dated 26.07.2020 instituted for the offences under Sections 341, 323, 354(B), 504, 506/34 of the Indian Penal Code and Section 8/12 of the POCSO Act.

The petitioner and one Mantu Kumar are alleged to have entered into the house of the Informant and attempted to outrage the modesty of the two minor daughters. The learned counsel for the petitioner submits that an absolutely false accusation has been hurled against the petitioner

Patna High Court CR. MISC. No.46526 of 2022(2) dt.25-11-2022 2/2 and Mantu Kumar for the reason that the fathers of both the accused persons were witnesses in a case lodged against the husband and brother-in-law of the Informant.

Aforesaid Mantu Kumar has been granted bail by a Bench of this Court vide order dated 15.12.2021 passed in Cr. Misc. No. 32210 of 2021.

The petitioner does not have criminal antecedents. Considering the aforenoted facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cum - Exclusive- Special Court (POCSO) Act, Patna in connection with Special Case No. 140 of 2020 arising out of Naubatpur P.S.
