JUSTICE BIRENDRA KUMAR ORAL ORDER 23-08-2017 Heard the learned counsel for the petitioners, the informant and the State.

This is a petition for grant of anticipatory bail for offence under Sections 363, 364 and 302 of the Indian Penal Code. The petitioners are under suspicion to have abducted to Nabalak Yadav and Pramod Yadav, the brothers of the informant.

The learned counsel for the State fairly concedes that the case diary does not reveal that there is any eye witness of the fact that the petitioners were seen along with the victim at any point of time.

The learned counsel for the informant opposed the prayer. However, does not dispute that there is any material in the case diary against the petitioners.

Considering the aforesaid fact, let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on

No.33947 of 2017 (3) dt.23-08-2017 2/2 anticipatory bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each in connection with Yadopur P.S. Case No. 21 of 2017 to the satisfaction of the Chief Judicial Magistrate, Gopalganj, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
