Heard Mr. Aaruni Singh, learned counsel for the petitioner and learned counsel for the State. This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner to quash the order dated 14.02.2017 passed in Confiscation Appeal (Forest)- (Nawada Case No. 15(M) of 2015) by the court of District Magistrate-cum-Collector, Nawada whereby he has upheld the order of the court of Authorized Officer-cum-Divisional Forest Officer, Nawada dated 05.02.2015 passed in Confiscation Case No.4 of 2014 wherein the prayer of the petitioner for release of

Patna High Court Cr.Misc. No.25061 of 2017 (2) dt.28-06-2017 2 / 2 his vehicle (Tractor Trolley) so seized in connection with Crime Report No.12(P) dated 04.06..2013 was rejected. After some arguments, in view of the statutory provision prescribed under Section 52-B of the Indian Forest Act, learned counsel for the petitioner seeks leave to withdraw the present application in order to file revision before the Secretary, Forest and Environment Department, Government of Bihar against the order of the court of District Magistrate-cumCollector, Nawada. Leave is granted.
