The accusation is of executing of a sale deed by the petitioner on 16.11.2012, in favour of the complainant/opposite party no. 2. When the complainant /opposite party no. 2 produced the sale deed before the Circle Officer for mutation of the said land, he came to know that father of the petitioner has already sold the said land.
The provisional bail has been granted to the petitioners above-named vide order dated 07.07.2017 by a coordinate bench
Patna High Court Cr.Misc. No.25642 of 2017 (4) dt.11-09-2017 2/2 of this court.
Learned counsel appearing on behalf of the petitioners submits that in fact the complainant/opposite party no. 2 filed a money suit no. 15/13 against the petitioner for recovery of Rs. 1,12,680/- which has been decreed on 17.07.2017. Learned counsel for complainant/opposite party no. 2 also submits that the money suit filed by the complainant/opposite party no. 2 has already been decreed in his favour. Having considered the facts and the circumstances of the case and the submission of the parties, the provisional bail granted on 07.07.2017 to the petitioners, above named, is hereby confirmed.
