JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2018 The petitioners are apprehending their arrest in connection with Sono P.S. Case No. 68 of 2017, registered for offences punishable under Sections 341, 323, 325, 448, 307, 379, 504 and 34 of the Indian Penal Code.

Allegation against the petitioners is of assaulting the informant causing grievous injury to him.

Submission of learned counsel for the petitioners is that they have falsely been made accused in this case and only one injury has been caused to the informant, which is alleged to be grievous and is attributed to the petitioner no. 1 only and so far other petitioners are concerned no specific allegation has been attributed.

Patna High Court Cr.Misc. No.30835 of 2018 (3) dt.09-08-2018 2/2 Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners and submitted that all the petitioners equally participated in the occurrence and caused grievous injury to the informant.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioners rather they should surrender and pray for regular bail, which would be considered on its own merit. (Vinod Kumar Sinha, J) sunil/Amjad/- U T
