In this case, the petitioner is seeking anticipatory bail in connection with Sitamarhi P.S. Case No.20 of 2014, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 332, 333, 307, 353, 431 and 186 of the Indian Penal Code and under Section 5/6 of the Bihar Essential Service Maintenance Act, 1947.

Allegation has been made that the petitioner, who is the director of a Coaching Institute, to have called the students of Harijan hostel to assault the public on the road. Learned counsel for the petitioner submits that the name of the petitioner was not there in the F.I.R, but later on,

Patna High Court Cr.Misc. No.24923 of 2017 (2) dt.20-07-2017 2/2 his name was added. He further submits that there is no specific allegation against the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner-Subodh Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case No.20 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
