In this case, the petitioners are apprehending their arrest in connection with Manjhi P.S. Case No. 05 of 2017 registered for offences under sections 323, 341, 379, 307, 504/34 of the Indian Penal Code.

As per allegation made in the F.I.R. when the Informant was returning after closing his shop, the accused persons intercepted him and assaulted with fists and slaps due to which he fell down. Mangal Yadav fired with pistol upon the Informant with an intention to kill him but, the Case Diary does not show that any such fire-arm has been used. It is also a case that

Patna High Court Cr.Misc. No.26087 of 2017 (3) dt.11-08-2017 earlier the petitioners have lodged a case against the Informant of the present case with respect to teasing of a girl customer and when the petitioners objected for the same, he and his associates came and assaulted the petitioners.

Looking to the entire facts and circumstances of the case, let the petitioners, namely, Mangal Yadav and Chandan Yadav, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Saran in connection with Manjhi P.S. Case No. 05 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
