JUSTICE SHIVAJI PANDEY ORAL ORDER 13-07-2017 Learned counsel for the petitioners submits that since the petitioner no.3, namely, Chandra Mani Mishra, has been arrested, this application has become infructuous as against him. Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are apprehending their arrest in connection with Chainpur P.S. Case No. 68 of 2017 registered for offences under sections 448, 341, 323, 307, 379, 504/34 of the Indian Penal Code.
From the First Information Report, it appears that the dispute is related to flowing of the dirty water in the sewage beside the house of the petitioners. An allegation has been made
Patna High Court Cr.Misc. No.25063 of 2017 (2) dt.13-07-2017 against the petitioners to have snatched a golden chain amounting Rs. 60,000/-.
As it is a dispute between the neighbours with respect to sewage water, let the petitioner nso. 1 & 2, namely, Angad Mishra and Bhushan Mishra @ Chandra Bhushan Mishra, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhabua (Kaimur) in connection with Chainpur P.S. Case No. 68 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
