Permission is sought to withdraw the application with respect to petitioner no. 3 who has been arrested and whose name has wrongly been typed as Bindu Devi in place of Bimal Devi.
Let the name of petitioner no. 3 be read as Bimal Devi.
The application with respect to petitioner no.
Patna High Court CR. MISC. No.3990 of 2021(2) dt.05-08-2021 2/3 3/Bimal Devi is dismissed as having become infructuous. The petitioners no. 1 and 2 seek bail in anticipation of their arrest in connection with Sadar (Hajipur) P.S. Case No. 460 of 2020 dated 15.08.2020 instituted for the offences under Sections 304(B) and 34 of the Indian Penal Code.
They are the younger brothers of the husband of the deceased.
The husband of the deceased is in custody.
Learned counsel for the petitioners has submitted that there is no specific accusation against the petitioners and from the facts narrated in the FIR and materials collected during investigation, it appears to be a case of suicide by hanging.
Considering the relationship of the petitioners with the deceased and taking into account that the husband of the deceased is in custody, the petitioners no. 1 and 2 are directed to be released on bail, in the event of their arrest or surrender before the court below
Patna High Court CR. MISC. No.3990 of 2021(2) dt.05-08-2021 3/3 within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Sadar (Hajipur) P.S.
