JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-07-2017 Heard learned counsel for the petitioners and learned APP representing the State.
The petitioners apprehend their arrest in connection with Mansi P.S. Case No. 69 of 2017 registered for the offences punishable under Sections 341, 323, 504, 506, 307/34 of the Indian Penal Code.
Allegedly, when the informant was coming to his house after tuition, the petitioners started abusing him and when he opposed, then, on the order of petitioner no. 1, petitioner no. 2 assaulted with iron rod on the head and when he fell down both assaulted with fat and feet, the informant regained his sense in hospital.
Submission is of false implication and that one injury and complaint of vomiting were found which are simple in nature
Patna High Court Cr.Misc. No.24915 of 2017 (2) dt.14-07-2017 vide annexure-2, the petitioners due to enmity have been implicated, no such offence as alleged has been committed and as such the petitioners deserve sympathetic consideration. Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 69 of 2017, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
