Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Parasbigha P.S. Case No. 113 of 2021 instituted for the offences under Sections 399, 402, 412 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 11.07.2021, has antecedent of two cases and charge sheet has been submitted.
Allegation is of recovery of one live cartridge from the possession of the petitioner.
Learned counsel for the petitioner submits that mere recovery of cartridge without gun is useless and, as such, the
Patna High Court CR. MISC. No.55820 of 2021(2) dt.22-02-2022 2/2 petitioner has been falsely implicated in the present case. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jehanabad in connection with Parasbigha P.S. Case No. 113 of 2021, with condition that one of the bailors shall be the father (Randhir Kumar) of the petitioner. (Satyavrat Verma, J) Kundan/- U T
