JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-07-2017 Heard learned Counsel for the petitioners, learned Counsel representing the informant and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Complaint Case No. 679(C) of 2010, disclosing offences under Section 500 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Allegedly, the marriage of the daughter of Opposite Party No. 2 (complainant) was fixed with son of the petitioner no. 2, namely, Ranjit Raut. The said Ranjit

Patna High Court Cr.Misc. No.25863 of 2017 (2) dt.11-07-2017 2/2 Raut is said to have refused to marry the daughter of the informant. The petitioner no. 1 is brother of the said Ranjit Raut; whereas, petitioner no. 2 is his mother. Considering the nature of dispute between the parties, this application is allowed.

Let the petitioners, namely, Sanjit Paul and Foolpari Devi, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Rosera, Samastipur, in connection with Complaint Case No. 679 (C) of 2010, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
