1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 469 and 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and from perusal of the allegation as alleged in the F.I.R., it would manifest that informant alleges that the land in dispute was settled in favour of his grandfather by the authorities, but then the accused persons got the Jamabandi of the land created fraudulently in their name, further the informant challenged the Jamabandi before the DCLR and the ADM, but then lost and when the

No.49945 of 2025(2) dt.01-09-2025 2/3 matter travelled before the Commissioner, a report was called for and it is alleged that the report which was submitted before the Commissioner was found forged and fabricated, it is alleged that it was the Circle Officer who had forwarded the report of the DCLR to the Commissioner which was found forged.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner is a government servant and is aware of the consequences which would entail in the event if it is found that petitioner indulged in any such kind of forgery. It is also submitted that informant has also filed a title suit being Title Suit No. 239 of 2023 in which the beneficiaries are party. It is next submitted that petitioner will not abscond rather will co-operate in the investigation to prove his innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.49945 of 2025(2) dt.01-09-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with K. Nagar (Srinagar) P.S. Case No. 663 of 2023 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned Trial Court bringing to its notice that petitioner despite giving assurance to this Court is not co-operating in the investigation, in that event the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner.

8. Let a copy of this order be sent to the concerned Police Station through the learned Trial Court.

9. Accordingly, the instant anticipatory bail application is allowed.
