2. In this case, the petitioner is seeking regular bail in connection with Vidyapatinagar P.S. Case No. 91 of 2023 (GR No. 544 of 2023), registered for the offences punishable under Sections 341, 323, 326A, 307, 504, 506/34 of the IPC.
3. As per allegation, the petitioner used to abuse and quarrel with the informant. On 24.06.2023, the petitioner, along with his wife, came to the house of the informant and started abusing him. Further, the petitioner assaulted the informant on his head by throwing acid bottle and when his wife came to rescue him, she too was assaulted on her head.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been
Patna High Court CR. MISC. No.54981 of 2024(2) dt.21-08-2024 2/2 implicated in this case. He is a person of clean antecedent. He has submitted further that the petitioner is own brother of the informant and he is under custody since 07.03.2024.

Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Vidyapatinagar P.S. Case No. 91 of 2023 (GR No. 544 of 2023), subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
(ii) The petitioner shall remain present physically on each and every date before the court below. In case of failure on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bonds of the petitioner.
