2. The petitioner is apprehending arrest in connection with Runnisaidpur P.S. Case No. 598 of 2023 instituted under Sections 341, 323, 447, 302, 504, 506/34 of the Indian Penal Code lodged on 05.12.2023 by the informant, Khushbu Devi.

3. As per the prosecution story, the informant, the lady alleged that earlier one of her agnate, Ravi Choudhary entered her house and had threatened her as also her son, Himanshu Choudhary. They, anyhow managed to escape and this was informed to her husband (late Ashok Choudhary). As her husband was returning from motorcycle on NH-77, all the accused persons which include Ravi Choudhary and his brother-

No.48469 of 2024(2) dt.07-08-2024 2/2 in-law, Sujeet Kumar Singh (the petitioner herein) beside Raju who gave repeated knife blow on the body of the informant's husband, as a result, he was badly injured. This was immediately informed by her husband on mobile and they rushed to the place, took the husband to Nandipat Memorial Hospital but on the way he succumbed to the injury. Accordingly, the FIR.

Though, learned counsel for the petitioner tried to impress upon this Court that the place of occurrence and the residence of the petitioner as apart, Ms. Mazoomdar pointed out that not only in the FIR, they have been named, the person who got the injury called the wife and informed about the accused persons.

5. Considering the fact that the injury led to the death of the husband of the informant and the petitioner is one of the alleged assailant in the said FIR, no case of anticipatory bail is made out, the same is accordingly rejected.
