JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is the mother-in-law of the deceased and is facing accusation punishable under Section 304 B of the Indian Penal code.
The incidence occurred on 30.4.2016. The victim died of the burn injuries on 4.5.2016. The informant ( father ) has alleged that the petitioner had also participated in commission of crime. It is submitted that the case was thoroughly investigated wherein it was found that the petitioner was not at home. When the petitioner returned to home she carried the victim to the hospital where she remained under treatment of the doctor several days before succumbing to the injury. For these reasons, it is submitted, referring to Annexure-2 that she was not sent up
Patna High Court Cr.Misc. No.24828 of 2017 (2) dt.13-07-2017 2/2 by the Investigating agency upon conclusion of investigation. The Court, however, took cognizance against her as well. In the facts and circumstances of the case, in the event of her arrest or surrender before the Court below within a period of four weeks from today, the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Purnea in connection with Amour P.S. case No. 59 of 2016, G.R. Case No. 1326 of 2016, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 with the further following condition:- (i) One of the bailors shall be the own/close family member of the petitioner.
