The petitioners apprehend their arrest in connection with Tisiauta P.S. Case No.100 of 2020 registered for offences under Sections 147, 148, 149, 341, 379, 324, 354, 307, 323 and 504 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner no.3, namely, Braj Nandan Rai @ Birju Rai @ Braj Nandan Kumar was arrested during the pendency of this
Patna High Court CR. MISC. No.2492 of 2021(3) dt.23-11-2021 2/2 application and he has been granted bail. Hence, he prays for withdrawal of application.
Prayer is allowed. The application for anticipatory bail is dismissed as withdrawn so far as petitioner no.3, namely, Braj Nandan Rai @ Birju Rai @ Braj Nandan Kumar is concerned.
So far as other petitioners are concerned, learned counsel for the petitioners submits that charge sheet has been submitted under bailable sections of the Indian Penal Code against the petitioner. In that view of the matter, this application for anticipatory bail has become infructuous. Hence, learned counsel prays for withdrawal of the same.
