This application for anticipatory bail arises out of Bakhtiyarpur P. S. Case NO. 30 of 2013, disclosing offences under Sections 467,468,471,420,120B read with Section 34 of the Indian Penal Code.

Allegation against the petitioners is that they got transferred some piece of land in their favour through registered sale deeds executed by the brother-in-law of the co-sharer of the informant.

Learned counsel for the petitioners has submitted that apparently a dispute is of civil nature. Learned counsel for the informant, on the other hand, has opposed the prayer for bail and has submitted that the petitioners and others, in a planned manner have got several lands transferred in their

names.

However, considering the facts and circumstances of the case and the nature of accusation, this application is allowed.

Let the petitioners above-named in the event of their arrest/surrender within six weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Bakhtiyarpur P. S. Case No. 30 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
