JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bheldi P.S. Case No. 03 of 2019 registered for the offences punishable under Sections 341, 323, 379, 494, 498A, 34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Allegation against the petitioner is that he subjected the informant to assault and ousted her from the house with respect to demand of Rs.5 lac and further allegation is that petitioner has solemnized second marriage with another lady. Submission of learned counsel for the petitioner is that the allegation of demand is false and concocted and he has not solemnized second marriage, which he has stated in paragraph-12 of the petitioner and he is still ready to keep her with dignity and care.

In view of above facts and circumstances, this application is disposed of with direction to petitioner to surrender in the court below on 30.9.2019 and on that day informant shall also remain present in court. Further petitioner to file an affidavit stating that he is ready to keep the informant with him with dignity and care and will not subject her to torture and on filing of affidavit petitioner shall be released by the court below on provisional bail for a period of six months and during that period the court below shall call for both the parties in court in third week of every month to watch their conduct and marital relationship between them and once the court is satisfied with their conduct, specially the petitioner and marital relationship between them, the court below shall confirm the bail bonds of the petitioner, otherwise the court is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bonds of the petitioner.
