2. The petitioner seeks bail in connection with Salimpur P.S. Case No. 86 of 2026 instituted for the offences under Sections 318(2), 336(3), 338, 340(2), 112(2) of the Bharatiya Nyaya Sanhita, 2023.

3. Prosecution case, in short, is that the informant alleges that, on the pretext of opening bank accounts for receiving the Government toilet construction incentive, her Aadhaar card, PAN card, photograph, and mobile number were collected during a camp organized by Canara Bank, whereafter a bank account was allegedly opened in her name and funds were fraudulently deposited and withdrawn without her

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that the petitioner has been implicated solely because he is the proprietor of the marriage hall where the bank camp was allegedly organized, without any specific allegation of his involvement in the alleged offence. He further contended that neither the F.I.R. nor the statements of witnesses during investigation alleged that the petitioner induced, persuaded, or assisted anyone in opening any bank account or collecting documents. He further submitted that the investigation only reveals that the marriage hall was rented for one day for 1,000/-, which by itself does not establish any ₹ criminal liability or knowledge on the part of the petitioner. Learned counsel lastly submitted that there is no material to show the petitioner's knowledge or participation in the alleged fraud. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.03.2026 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.46894 of 2026(2) dt.21-07-2026 3/3 of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Salimpur P.S. Case No. 86 of 2026.
