2. The instance application for regular bail has been filed by the petitioner in connection with Sessions Trial No. 1361/2022 arising out of Bhadaur P.S. Case No. 105 of 2021 instituted for the offence u/s 324, 326, 307, 34 of the Indian Penal Code and section 27 of the Arms Act.
3. Earlier the application for regular bail of the petitioner was twice rejected. Firstly, his prayer was rejected by this Court vide order dt. 15.2.2023 in Cr. Misc. No. 53682 of 2022 with a direction to expedite & conclude the trial as soon as possible. Secondly, the same was rejected by this Court vide order dt. 25.8.2023 in Cr. Misc. No. 47696 of 2023 with a direction to trial court to conclude the trial within eight months.
4. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.51283 of 2024(2) dt.19-07-2024 2/2 that the trial has not been concluded as yet despite eight months' time being sought by the trial court in its report. There is no hope to conclude the trial in near future. The petitioner is languishing in judicial custody since 24.5.2022.
5. Considering the aforesaid facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bhadaur P.S. Case No. 105 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 1st, Barh at Patna with subject to following conditions:
(i) the petitioner shall co-operate in the trial and shall be present on each and every fixed date and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
(ii) In case, the petitioner tempers with the evidence or threatens the witlessness, his bail bonds shall be cancelled by the Court below.
