The petitioners apprehend their arrest in Bidupur P.S. case No. 110 of 2017 under Section 341, 323, 307, 354/34 of the Indian Penal Code.

Abhishek Kumar, the informant, made allegation against his father, mother, brother and one co-villager, Dilip Paswan, petitioner No.4, that they all assaulted him and his wife due to non fulfillment of demand of additional dowry. The informant alleged that he solemnized love marriage with Shilpy Kumari, daughter of Bipin Thakur.

The learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.25965 of 2017 (2) dt.07-07-2017 2/2 the occurrence is said to have taken place on 15.07.2016 but the FIR was lodged on 30.03.2017. It is submitted that entire allegation is false and concocted. The informant wanted to grab the land of his brother and father that is why this false case has been lodged. The informant got simple injuries that too on account of fall.

Considering the nature of allegations made against the petitioners and the fact that informant is none than the son of petitioner No.1 and 2 and he alleged that his father and mother assaulted him and his wife due to non fulfillment of demand of dowry, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Bidupur P.S. Case No. 110 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
