The petitioner is apprehending his arrest in connection with Gardanibagh P.S.Case nO.368 of 2017 (Arising out of Complaint Case No.4072 (C ) of 2017) registered for offences punishable under Sections 406, 420, 448, 504, 506 and 120B of the Indian Penal Code.

Allegation against the petitioner is that he entered into the agreement with the complainant with respect to a piece of land and took Rs.4,45,000/- but neither he has executed the sale deed nor returned the money.

Submission of the learned counsel for the petitioner is that one has given two cheques but that have not been encashed and still she is ready to pay the amount, if some reasonable time is

Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail.. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order along with a bank draft of Rs.2,25,000/- payable in the name of the O.P.No.2 and he will be released on provisional bail to the satisfaction of the court below in connection with P.S.Case No.368 of 2017 for the period of two months and he has to pay rest of the amount within a period of two months, otherwise his bail bond shall be cancelled. With the aforesaid observation, this application is disposed of.
