2. The petitioner seeks bail in connection with Jehanabad (Karauna OP) P.S. Case No. 715 of 2021 dated 16.11.2021 registered for the offence punishable under Sections 8/20 (b) (ii) (c) of the Narcotic Drugs and Psychotrophic Substances Act.

3. The allegation is of recovery of Ganja like substance from the house of apprehended persons. It is alleged that 37.950 kg 'Ganja' was recovered from Amit Kumar, 3.970 kg was recovered from Gangadhar Pandey and 2.20 kg was recovered from Dipak Pandey. It is further alleged that a polythene was thrown by one Sanjit Kumar

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the petitioner was not arrested from the place of recovery. Only on the basis of confessional statement of co-accused Amit Kumar, the petitioner has been made accused in this case. It is submitted that neither there is any recovery from the house of the petitioner nor from the conscious possession of the petitioner. It is further submitted that Dipak Pandey has been granted bail vide order dated 29.07.2022 passed in Criminal Miscellaneous No. 19199 of 2022 by a co-ordinate Bench of this Court. Lastly, it has been submitted that the petitioner is in custody since 13.04.2024, having no criminal antecedent and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the
