JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 33,41 and 42 of the Indian Forest Act.

It is alleged that a tractor was intercepted while unloading stone chips carried out from the forest area but the driver and cleaner managed to flee away from the place of occurrence.

It is submitted by learned counsel for the petitioners that the petitioners are neither tractor owner nor the driver or cleaner of the tractor. The prosecution report reflects that it is being launched against unknown tractor driver but in the formal part of the FIR petitioners' names have been inserted. Statement has been made in paragraph 3 of the

Patna High Court Cr.Misc. No.31914 of 2014 (2) dt.03-02-2015 2/2 petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Nawada in connection with Forest Case No. 196 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
