JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-07-2019 Petitioners seek bail in anticipation of their arrest in connection with Sabour P.S. Case No. 8 of 2019 registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

Allegation as per written report is that niece of the informant was enticed away by one Dhurkheli Mandal and petitioners are father and mother of said Dhurkheli Mandal, who have assured the informant to trace out the girl but later on they have not assisted the informant.

Submission of learned counsel for the petitioners is that they are father and mother of the main accused and there is no allegation of kidnapping against them and they are old aged

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Sabour P.S. Case No. 8 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that they have to cooperate in the investigation and appear before the police as and when required, otherwise their bail bonds shall be cancelled.
