In this case, the petitioners are apprehending their arrest in connection with Bakhtiyarpur P.S. Case No. 246 of 2016 registered for offences under sections 302/201/34 of the Indian Penal Code.
An allegation has been made against the petitioners to have killed the victim but, from the case diary, it appears that it is a case of suicide.
Learned counsel for the petitioners has pressed certain paragraphs of the case diary wherein it has been stated that the victim has committed suicide.
Looking to the entire facts and circumstances of the
Patna High Court Cr.Misc. No.26064 of 2017 (3) dt.11-08-2017 case, let the petitioners, namely, Nagendra Rai @ Nagendra Kumar and Jitendra Rai @ Jitendra Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 246 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
