The petitioner has prayed for bail in a case registered for the offence punishable under sections 387, 120B, 506 of the Indian Penal Code..

Prosecution case relates to demand of extortion money of Rs. Three lakh by mobile no. 918092490769 on the informant's mobile.

It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. Petitioner has no concern with mobile phone or with caller person. Petitioner's name has been dragged in the present case on the basis of confessional statement of Overseer Sahani and

Patna High Court CR. MISC. No.46045 of 2022(3) dt.11-01-2023 2/2 save and except nothing has come against the petitioner to implicate him in the present case. He is languishing in judicial custody since 20.01.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari P.S. Case No. 272 of 2021.
