2. In this case, the petitioner is seeking regular bail in connection with Kudra P.S. Case No. 113 of 2024, registered for the offences punishable under Sections 302, 34 of the IPC.

3. The informant alleges in the fardbeyan that his son went with the petitioner to Bhabua but his son didn't return till late in the night. Further, the petitioner informed him on mobile that his son fell down near Kudra Kajhar Ghat Bridge and became badly injured. The informant reached there and saw his son lying in injured condition. The injured was rushed to the hospital where he was declared dead.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.48311 of 2024(4) dt.01-10-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. He has submitted further that the deceased was friend of this petitioner. Both the petitioner and the deceased smoked heroin and thereafter, the deceased died after falling in intoxicating condition. The petitioner soon thereafter informed the father of the deceased. There is no motive at all for commission of murder of the deceased.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Kaimur at Bhabua in connection with Kudra P.S. Case No. 113 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
