The petitioner seeks pre-arrest bail in connection with Guthani P.S. Case No.24 of 2017 registered for the offences punishable under Sections 498-A, 323 and 406 of the Indian Penal Code.

Regard being had to the submission that prior to the institution of the present FIR on 18.02.2017, the petitioner had instituted a Matrimonial Case No.657 of 2016 before the court of

No.25234 of 2017 (2) dt.01-07-2017 2 / 2 Principal Judge, Family Court, Deoriya under Section 9 of the Hindu Marriage Act for restitution of conjugal rights and after receipt of notice in the said case, the instant case was instituted, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Guthani P.S. Case No.24 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.
