In this case, the petitioner is seeking anticipatory bail in connection with Barbigha P.S. Case No.105 of 2019, registered for the offence punishable under Sections 401, 414, 379/34 of the Indian Penal Code.

A stolen motorcycle has been recovered from the house of co-accused Santosh Mistry @ Sanjay, who has taken the name of the petitioner as a member of gang. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

However, if the petitioner surrenders before the Court
