APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 24-02-2021 The instant application has been filed for modification of the order dated 08.07.2020 passed in Cr. Misc. No. 7599 of 2020.

Heard learned for the petitioner and the learned APP for the State.

Learned counsel for the petitioner is expected to honor his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon.

The learned counsel for the petitioners draws attention of the Court towards the First Information report. The petitioner No.2 is the third accused in the column of accused persons, wherein, his father's name has been written as "Umesh Singh" He submits that due to inadvertence, the name of petitioner's No-2 father has been mentioned as "Shatrodhan Singh". The

Patna High Court CR. MISC. No.9975 of 2021(2) dt.24-02-2021 2/2 same is typographically error in the anticipatory bail application filed by the petitioners.

In view of such typographical error in the anticipatory bail petition, the error has also crept in the order dated 08.07.2020 whereby the prayer for anticipatory bail was allowed. The Court, having gone through the same, finds that the submissions based on the FIR are correct. The correct name of the petitioner's No.2 father may, accordingly, be modified in the order dated 08.07.2020 passed in Cr. Misc. No. 7599 of 2020, to be read as "Umesh Singh". In view of such modification, having been effected today, the time granted for surrender stands extended by four weeks from today. The modification application is allowed.
