Patna High Court L.P.A No.958 of 2016 dt.13-12-2022 2/3 Supplies Corporation and Mr. Krishna Kant Singh for the respondent no.1.
After some arguments, the parties agree that this case be disposed of in terms of the order dated 20.04.2022 passed by this Bench in L.P.A. No. 698 of 2016 in CWJC No. 3837 of 2016.
We are of the considered view that the grievance of the respondent be also placed with the Committee, which shall examine all aspects of the matter and shall submit a report.
In case it is found that the respondent had supplied paddy within the deadline so fixed by the Hon'ble Supreme Court and for which procurement, the farmers have been adequately compensated/paid, necessary orders shall be passed, redressing the grievance of the respondent.
In case the respondent is aggrieved by any decision of the Committee, it will be open for the
Patna High Court L.P.A No.958 of 2016 dt.13-12-2022 3/3 respondent to approach the Hon'ble Supreme Court in those batch of SLPs for ventilating their grievances. Mr. Singh, learned counsel for the appellant, submits that the Committee is still functioning and the SLPs, referred to in this order, are still pending consideration before the Hon'ble Supreme Court. With the aforenoted observation, this appeal also is disposed off in terms of the order passed in LPA No. 698 of 2016.
It is expected that the Committee shall take into account all the grounds raised by the respondent in the writ petition as also in this appeal and only thereafter shall make any recommendation.
