Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with two other accused persons are suspected to have killed the son of informant as prior to the occurrence this petitioner had threatened to kill the son of the informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is no eye witness of the occurrence. As per FIR son of the informant disappeared on 04.06.2021 but only after recovery of dead body on 08.06.2021 present FIR was lodged

Patna High Court CR. MISC. No.55894 of 2021(2) dt.07-12-2021 2/2 and only suspicion has been raised against this petitioner. Petitioner claims clean antecedent and is in custody since 10.06.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner and the fact that petitioner is a lady, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kavindu Kumar, Judicial Magistrate, 1st class, Pupri at Sitamarhi in connection with Sursand PS case No.266/2021.
