JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201 of the Indian Penal Code. As per the prosecution case, on recovery of dead body of a 35 years old lady of which throat was cut and face and neck was covered with blood FIR was registered against unknown.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation in his confessional statement. Petitioner is in custody since 12.01.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that on the confession of this petitioner knife used in the crime has been recovered from the possession of this petitioner and cause of death was injuries caused by sharp edged weapon.

Patna High Court CR. MISC. No.55896 of 2021(5) dt.21-02-2022 2/2 Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
