Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in Magadh University P.S. Case No. 126 of 2019 registered for the offences punishable under Sections 457 and 354(B)/34 of the Indian Penal Code and Section 7 of the POCSO Act. It is a case of outrage the modesty of the informant, namely, Puja Kumari.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case and he

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

From perusal of the case diary, it appears that there is ample evidence that the petitioner and co-accused had outrage the modesty of the informant, namely, Puja Kumari. It also appears that the processes under Section 83 has also been issued against the petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner.
