The petitioners apprehend their arrest in Kahalgaon (Ghogha) P.S. Case No. 38/2017, registered for the offences punishable under Sections 147, 148, 149, 353, 337, 338, 332, 333, 307, 504, 506, 224 and 225 of the Indian Penal Code. The informant, police officer, alleged that he along with other police officials proceeded to arrest Jai Prakash Mandal, accused of Kahalgaon (Ghogha) P.S. Case No. 450/2016. Jai Prakash Mandal was apprehended but his family members and others surrounded Jai Prakash Mandal and got him freed from the custody of the police.
Patna High Court Cr.Misc. No.26045 of 2017 (2) dt.13-07-2017 2/2 Learned counsel for the petitioners submits that the petitioners are wife, daughters and other family members of Jai Prakash Mandal. No specific allegation is made against the petitioners. It is further submitted that Sitaram Mandal, who is alleged to have instigated the mob to get Jai Prakash Mandal freed from custody of the police, has already been allowed anticipatory bail vide order dated 16.05.2017 passed in Cr. Misc. No. 16952/2017 by a co-ordinate Bench of this Court.
Considering the facts aforesaid and the fact that there is no specific allegation against the petitioners and the petitioners are unmarried girls and wife of Jai Prakash Mandal and Manoj Kumar Mandal, the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 38/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
