JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2019 The learned counsel for the petitioner seeks liberty to challenge the order dated 07.06.2019 passed under Section 6 of the Bihar Public Land Encroachment Act, 1956, by the Circle Officer, Bettiah, West Champaran in Encroachment case no. 14 of 2018-19 by filing an Appeal under Section 11 of the Bihar Public Land Encroachment Act, 1956.
Having regard to the limited submission made by the learned counsel for the petitioner, the petitioner is granted liberty to file an appeal under Section 11 of the Bihar Public Land Encroachment Act, 1956 against the order dated 07.06.2019 within a period of six weeks from today. It is
Patna High Court CWJC No.14429 of 2019(2) dt.23-07-2019 2/2 needless to state that till the passing of the final order by the appellate authority, status quo existing as on today, shall be maintained. However, in case no appeal is filed under Section 11 of the Bihar Public Land Encroachment Act, 1956, within a period of six weeks from today, the aforesaid order granting status quo shall stand revoked automatically. The present writ petition stands disposed off on the aforesaid terms.
