The petitioner is apprehending his arrest in connection with Kumarkhand P.S.Case no.84 of 2013 registered for offences punishable under Sections 147, 148, 149, 323, 324, 341 and 307 of the Indian Penal Code.
Petitioner is named in the FIR and allegation against the petitioner and other accused persons is that they assaulted the son of the informant by lathi and Dabiya but the specific allegation of assault is against Jabbar Mian. It further appears that the case is of the year, 2013.
Submission of the learned counsel for the petitioner is that no specific allegiant has been attributed against him and he was not aware of the fact that he has been made accused in this case, as he is labourer.

Having heard both sides and in view of the facts and circumstances, as stated above, and considering the fact that the case is of the year, 2013, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of submissions as made by the learned counsel for the petitioner and shall be disposed of, if possible, on the same day. With the aforesaid observation, this application is disposed of.
