ANJANA MISHRA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 12.4.2014 in S.Tr.No.914/12 arising out of Gopalpur (Rangra) P.S. Case No.16/12 for the offences under Sections 364, 302, 201/34 of I.P.C.

It is submitted on behalf of the petitioner that though he has been named in the F.I.R. there is no substantial evidence against this petitioner so as to connect him with the present case. It is further submitted that one similarly situated Birendra Yadav who has been named in the F.I.R., has already been extended the privilege of bail by this Court vide Cr.Misc. No.34365/12 on 2.1.2013.

Patna High Court Cr.Misc. No.32126 of 2014 (5) dt.09-01-2015 2/2 Considering the aforementioned submissions and also the fact that the petitioner is in custody since 12.4.2014, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.D.J. 1st, Naugachia, Bhagalpur, in S.Tr.No.914/12 arising out of Gopalpur(Rangra) P.S.Case No.16/12.
