The petitioner seeks bail in connection with Maheshkhut P. S. Case No.94 of 2021, instituted for the offences under Section 392/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 18.06.2021, charge-sheet has been submitted in this case and has antecedent of three cases. Allegation is of looting of pick-up van and Rs.5200/- from the informant by three unknown criminals. The learned counsel for the petitioner submits that F.I.R. was against unknown and the petitioner came to be arrested on the ground that the alleged looted pick-up van was being driven by him. The learned counsel submits that he had
Patna High Court CR. MISC. No.57069 of 2021(2) dt.02-03-2022 2/2 taken pick-up van on hire from his friend and as such, was not aware that it was the looted pick-up van.
Learned A.P.P. opposes the bail application and submits that petitioner has antecedent of three cases. Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Ms. Ankita Jaiswal, learned J. M., 1st Class, Khagaria in connection with Maheshkhut P. S. Case No.94 of 2021, one of the bailor shall be the father of the petitioner namely, Pawan Kumar Sah.
The application stands allowed.
