The present petition has been filed for grant of regular bail on behalf of the petitioners in connection with Forbesganj P.S. Case No. 149 of 2018 registered for the offence punishable under Section 379 of the Indian Penal Code.

The allegation made by the informant is regarding unknown person having stolen his motorcycle.

The learned counsel for the petitioners has submitted that the petitioners have been falsely made accused in the present case after being remanded from another criminal case in which they had been taken into custody merely on the disclosure made by the coaccused, namely, Rajesh Kumar Das (petitioner no. 2). It is submitted that no T.I. Parade has been held nor any recovery has been made from the possession of the petitioners so as to suggest their complicity in the matter. The petitioners are stated to be languishing in custody since 28.07.2018 in the present case.

No.42416 of 2019(3) dt.27-09-2019 2/2 The learned counsel for the petitioners has further submitted, in reference to the petitioner no. 2, that since his confessional statement is on record, he is ready and willing to abide by such conditions, as may be imposed by this Court. Accordingly, this Court deems it fit and proper to grant regular bail to the petitioner no. 1, namely, Ravi Kumar Sharma @ Pappu, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Civil Court, Araria/ concerned Court in connection with Forbesganj P.S. Case No. 149 of 2018. As far as petitioner no.

2, namely, Rajesh Kumar Das, is concerned, this Court deems it fit and proper to grant regular bail to him subject to deposit of a sum of Rs. 10,000/- (Rs. Ten thousand) before the Nazarat of the Civil Court, Araria whereupon he shall be granted regular bail subject to such conditions as may be deemed fit and proper to be imposed by the learned Court of Judicial Magistrate, 1st Class, Civil Court, Araria, in connection with Forbesganj P.S. Case No. 149 of 2018.

This application stands disposed off on the aforesaid terms.
