JUSTICE SANDEEP KUMAR ORAL ORDER 17-04-2025 By way of this writ application, the petitioner has prayed for the following reliefs:- "i. To issue an appropriate writ(s), order(s), direction(s) to the respondent authorities to
Patna High Court CR. WJC No.1601 of 2024(2) dt.17-04-2025 2/3 expeditiously conclude the proceedings of Case No.59 of 2023 under section 145 of the Cr.P.C. i.e. pending before the learned Court of the SubDivisional Magistrate, Pakridayal, East Champaran.
ii. To issue an appropriate writ(s), order(s), direction(s) to the learned court of the 2nd Additional District Judge, East Champaran, Motihari to decide the Criminal Revision No.178 of 2023 arising out of Case No.59 of 2023 which has been pending before the learned Court for quite some time now;
iii. To issue an appropriate writ(s), order(s), direction(s) to the respondent authorities to make the seizure list of the things kept in the office room at the Mela Bazaar, Madhubani and seal the premises in order to maintain the law and order situation in future;
iv. To issue an appropriate writ(s), order(s), direction(s) to the respondent authorities to provide adequate security to the petitioners on account of the threat perception by the private respondents.
v. That in the interim and without prejudice to the above, to issue an appropriate writ(s), order(s), direction(s) to the Receiver-cum-Station House Officer, Madhuban Police Station, Madhuban, East Champaran to restrict the commute of the private respondents on the land in question so as to maintain the law and order situation in terms of the order dated 20.05.2023 passed by the respondent no.4 herein under section 146 of
Patna High Court CR. WJC No.1601 of 2024(2) dt.17-04-2025 3/3 the Cr.P.C."

The Additional District & Sessions Judge-II, East Champaran, Motihari is directed to dispose of Criminal Revision No.178 of 2023 within two weeks from the date of receipt/production of a copy of this order and thereafter file a compliance report before this Court.

So far as the issue of appointment of S.H.O., Madhuban Police Station as Receiver is concerned, the petitioner may challenge the order by which the S.H.O. Madhuban Police Station has been appointed as Receiver in an appropriate forum/Court.
